Module 2: Understanding Contract Purpose and Form
Contract law is based on the principle expressed in the Latin phrase pacta sunt servanda, which is usually translated “agreements must be kept” but more literally means “pacts must be kept”. Contract law can be classified, as is habitual in civil law systems, as part of a general law of obligations, along with tort, unjust enrichment, and restitution.
Module 3: Pre-contract Negotiations
The biggest reason behind this is in today’s fast paced world nobody has time to sit back and fight, in case of an disagreement everyone looks for the best possible solution in less time. Today everybody is focusing on the principles of fairness, seeking mutual benefit and maintaining a relationship. This is what negotiation gives. Negotiation is one of the most important aspects in an individual’s life. Being able to negotiate well plays a key role in overall career of a person. But what is negotiation?
Module 4: Drafting a Contract
Writing a contract is an art. It is a step by step process. It should be done with great amount of care and caution. Drafting comes with huge responsibility, since everything that is important and related to the agreement is dependent on the final written draft presented in form of written contract.
Module 5: Preliminary Agreement Forms and Online Contracts
Parties to a commercial transaction may often commence negotiations on a plain sheet of paper prior to agreeing terms. The final agreement, as with non-binding heads of agreement, is based on the parties’ memorandum setting out their understanding of the proposed transaction.
